1. Introduction and Basis of Agreement
1.1 These terms and conditions (“Terms”) govern any transaction between Sense Organics NL BV (hereinafter “Sense Organics”) and its customer (hereinafter “Customer”) when purchasing goods via senseshop.dk or other form of agreement. When you place an order, you confirm that you are at least 18 years of age and that you have read, understood and accepted the Terms and Conditions.
1.2 All hemp/cannabis-related products sold by Sense Organics contain less than 0,2% THC in accordance with current Danish and EU legislation. The products cannot or should not be equated with illegal cannabis.
1.3 Sense Organics reserves the right to update and change the Terms and Conditions from time to time with 30 days' notice. The then-current version of the Terms and Conditions will be available on senseshop.dk.
2. Products, Purpose and Disclaimer
2.1 Product use
• The products are sold exclusively as collectors' items and/or souvenirs. They must not be consumed or heated above 60 degrees.
• Sense Organics' products are not to be considered medicines or foods, and cannot diagnose, treat or cure diseases.
2.2 Fictitious Names and Marketing
• The product names used are purely fictitious and serve marketing purposes only.
2.3 Laboratory analyses and Quality
• All products undergo laboratory tests to ensure that the THC content is below 0,2% and that the product quality is in accordance with current EU regulations.
• Test results are published to the extent practicable. The customer may request a copy to be sent by email or added physically to their order. However, Sense Organics encourages delivery by email to minimize paper usage.
• Please note that minor variations may occur between batch samples and the final product, especially for infused products.
2.4 Compliance with Local Laws
• When you place an order, you declare that you have investigated and comply with local regulations and restrictions that may apply to the import or possession of goods containing cannabinoids. Sense Organics operates under Danish law and complies with the requirements of this law.
3. Prices and Payment
3.1 Prices
• All prices stated are inclusive of Danish VAT and exclusive of any delivery costs, unless otherwise clearly stated.
• Current prices are listed on senseshop.dk and may be changed without prior notice, but not retroactively for orders already completed.
3.2 Payment methods
• Sense Organics accepts payment methods such as Dankort, Visa, Mastercard, MobilePay, Apple Pay and Google Pay.
• No transaction fees are charged on card payments.
3.3 Payment time
• Payment is only taken when the order is shipped, unless otherwise clearly stated when ordering.
• Payment is made via a secure payment server that encrypts all information to protect your data as best as possible.
4. Delivery
4.1 Delivery areas and times
• Sense Organics generally only delivers to selected countries in Europe.
• For orders in Denmark, the delivery time is usually 1-4 business days. If you order on a weekday before 17:00 PM, the item is often shipped the same day. Orders received on weekends or public holidays are shipped the next business day.
• Should the delivery time be extended unexpectedly, you will be contacted as soon as possible by email.
4.2 Delivery methods
• Sense Organics uses, among others: GLS, DAO365, Bring, UPS, DHL, PostNord.
• Delivery can be made to private addresses or parcel shops throughout Denmark. Greenland and the Faroe Islands are only delivered to private addresses.
4.3 Responsibility
- We do our best to deliver on time, but we cannot be held responsible for delays caused by: Customs processing, extreme weather conditions, strikes by shipping companies, or pandemics or other unforeseen events.
5. Right of Return and Cancellation
5.1 General
• You have a 14-day right of return for items purchased via the webshop. The 14 days are counted from the day you receive the item.
• If you wish to exercise your right of withdrawal, you must notify our support (support@senseshop.dk) in writing within 14 days of receiving the goods.
5.2 Scope and Costs of Returns
• You bear the cost of return and choose your own carrier.
• The product must be returned to Sense Organics no later than 14 days after you have notified your cancellation.
5.3 Condition of the Goods
• The product must be unopened and in the same condition as when received in order for you to receive a refund.
• If the product has been tried on, opened or used in a way that significantly reduces the resale value of the product, Sense Organics may consider that the value has been lost. In such cases, no refund will be given.
6. Cancellation and Refund
6.1 Cancellation of Order
• If you wish to cancel an order, please contact support (support@senseshop.dk) as soon as possible.
• If the order is canceled before it is shipped, you will pay nothing.
6.2 Cancellation after Dispatch
• If your order has already been packed and a tracking code has been sent, the shipping costs will be deducted from the total refund amount, regardless of the size of the order.
• Any delays that occur with the shipping company do not necessarily entitle you to additional compensation, unless otherwise agreed.
7. Right of complaint
7.1 Scope
• According to the Danish Sales Act, you have a 2-year warranty on products purchased from Sense Organics. The warranty covers material and manufacturing defects.
• Any errors or deficiencies must be reported to Sense Organics no later than 7 days after discovery, but within 2 years of purchase.
7.2 Exclusions
• The right to a complaint lapses if the product has been used incorrectly, stored inappropriately or otherwise treated in violation of the instructions that come with the product.
7.3 Exchange and Returns
• If the complaint is justified, Sense Organics will cover the return costs to a reasonable extent, except for cash on delivery.
8. Personal Data Policy (GDPR) and Cookies
8.1 General
• When you shop at Sense Organics, you provide certain personal information, which we treat confidentially and securely in accordance with applicable data protection regulations. Your data is stored and used only for the purposes for which it was collected.
8.2 Third parties
• Sense Organics uses third-party solutions for payment processing, shipping, etc. All subcontractors are subject to data processing agreements that ensure a similarly high level of data protection.

9. Laboratory Tests, Analyses and Cannabinoid Content
9.1 Purpose and Method
• Sense Organics conducts laboratory tests to ensure correct declaration and legal THC percentage (<0,2%).
• Test results are published as a guide and are based on random samples. There may be minimal variations from batch to batch, especially for infused products.
9.2 Infused Products
• For infused products, the stated percentage of a given cannabinoid added during production is according to the product label. However, minor deviations may occur during measurement.

• If you have a complaint about a product or are dissatisfied with your purchase, you can contact us at support@senseshop.dk. We strive to respond to all inquiries within 1-3 business days.

11. Disclaimer regarding Customs Control and Detention of Shipments
Disclaimer regarding customs inspections and detention of shipments
At Sense Organics ApS we strive to ensure that all our products comply with applicable Danish legislation. We would like to point out that shipments may be subject to inspection by the Danish Customs Agency or other authorities in order to verify the legality of the goods.
In the event that your package is detained by customs, this is beyond our control. Unfortunately, we cannot offer compensation until there is an official decision from the authorities involved regarding the status of the shipment. We recommend that you as a customer stay informed about applicable rules and restrictions for importing goods before making a purchase. Should your shipment be detained, the relevant authority will contact you with further information and guidance.
We are of course available to answer any questions and assist you in the process, as far as possible within the framework of the law.

12. Applicable law and venue
12.1 All disputes and disagreements that may arise in connection with purchases from Sense Organics are subject to Danish law.
12.2 Disputes must generally be brought before the Court in Copenhagen, unless mandatory legislation provides otherwise.
